Globalization and the Transformation of Environmental Law: Challenges for National Environmental Governance

Abstract

Globalization has fundamentally transformed the structure, sources, actors, and implementation of environmental law. Environmental problems such as climate change, biodiversity loss, transboundary pollution, deforestation, and marine degradation increasingly transcend national borders, making purely domestic regulatory approaches insufficient. This article examines how globalization influences the transformation of environmental law and identifies the principal challenges it creates for national environmental governance. The study employs normative legal research with conceptual, statutory, and international legal approaches. Primary legal materials include major international environmental instruments, while secondary materials consist of scholarly literature concerning global environmental law, environmental governance, international trade, and environmental rule of law. The study finds that globalization transforms environmental law through the internationalization of environmental norms, regulatory convergence, the growing influence of non-state actors, the interaction between trade and environmental regulation, and the expansion of rights-based environmental governance. Nevertheless, these developments create significant challenges for national governments, including regulatory fragmentation, tensions between economic competitiveness and environmental protection, unequal implementation capacity, sovereignty concerns, and enforcement deficits. Effective national environmental governance therefore requires neither regulatory isolation nor uncritical harmonization with global standards. Instead, states need adaptive legal frameworks capable of translating international environmental commitments into enforceable domestic norms while maintaining policy legitimacy, public participation, environmental justice, institutional capacity, and national developmental priorities. Strengthening environmental rule of law is consequently essential for ensuring that globalization contributes to, rather than undermines, sustainable environmental governance.
